DEPOSIT:
We require a 50% deposit to begin the job. 30% will be collected when the gutters are installed. The remainder will be collected once the job is complete.
INSTALLATION:
Gutters can be installed either on the wood fascia board or underneath the drip edge, as per customer preference or project requirements. The Customer acknowledges that the method of installation selected may affect the existing roof structure. Crespo Seamless Gutters shall not be held liable for any damages to the roof, fascia, drip edge, tiles, or related structures resulting from the chosen installation method. The Customer assumes all risks associated with the installation location and any consequential or incidental damages that may arise therefrom. The roof and surrounding work areas are assumed to be in good condition and safely support the weight of our workers and equipment. If you have any doubts consult a license roofer prior to installation.
For roofs covered by a warranty, it is the sole responsibility of the Customer to consult with their roofing contractor prior to the installation of gutters to ensure that the selected installation method will not void the roof warranty. The Company shall not be held liable for any voided roof warranties or warranty-related claims arising from the installation of gutters.
Crespo Seamless Gutters will make every effort to document any pre-existing damages prior to installation. We are committed to performing the work with the utmost care and professionalism, ensuring it is completed to the highest standards.
SCHEDULE:
The gutters need to be installed immediately after the roof has passed final inspection.
CHANGES TO SCOPE OF WORK (SOW):
Alterations to the Scope of Work shall obligate the Client to additional fees and costs. These may include but are not limited to: additional gutters, downspouts, rain chains, leaf guards, collectors, splash guards, and other materials. Should the scope of work change, revised estimates will be presented for approval before work can begin. Expenses not included above will be billed additionally. If Crespo Seamless Gutters is unable to meet the delivery schedule set forth in the Agreement due to delays by the Client or changes requested by the Client in the Scope of Work, Crespo Seamless Gutters may, at its discretion, revise the production schedule as necessary and provide for adjustments in the Project costs. Should the project extend for 45 days or more, Crespo Seamless Gutters reserves the right to bill the remaining balance in full. Please note, if a boom lift is required for the installation of gutters, the cost is not included in the quoted price.
ARBITRATION:
The Parties agree that any claim or dispute between them or against any agent, employee, successor, or assign of the other, whether related to this agreement or otherwise, and any claim or dispute related to this agreement or the relationship or duties contemplated under this contract, including the validity of this arbitration clause, shall be resolved by binding arbitration by the American Arbitration Association (or name other firm providing arbitration services, i.e., National Arbitration Forum), under the Arbitration Rules then in effect. Any award of the arbitrator(s) may be entered as a judgment in any court of competent jurisdiction. Information may be obtained and claims may be filed at any office of the American Arbitration Association.
VENUE:
The parties agree that venue for any claim or dispute between them or against any agent, employee, successor, or assign of the other, whether related to this agreement or otherwise, and any claim or dispute related to this agreement or the relationship or duties contemplated under this contract, including the validity of this arbitration clause, shall be in Miami-Dade County, Florida.
ACCEPTANCE BY DEPOSIT:
By submitting a deposit, the party acknowledges and agrees to be bound by the terms and conditions above.
WARRANTY:
Crespo Seamless Gutters offers a 5-year warranty for any leaks due to installation defects and a 20-year warranty on materials. These warranties do not cover damage caused by external factors, improper maintenance, or alterations made after installation.
